Risk Disclaimer

Last updated: DD Month YYYY

Read this before you download or use APEX Terminal or Omega Terminal. These applications are order-entry software. Once you connect a live broker account, they place real orders on real exchanges using your real capital. Nothing in the software simulates, delays or reviews an order before it is sent, beyond the pre-trade risk checks you yourself configure.

1. Trading risk

Trading in securities, futures, options and currency derivatives carries a substantial risk of loss and is not suitable for every investor. Derivative instruments in particular are leveraged, which means losses can exceed your initial margin and can accumulate faster than you are able to react. You may lose some or all of your capital.

Past performance of any strategy, whether tested on paper or traded live, is not indicative of future results. Market conditions change, liquidity disappears, and an approach that worked yesterday can fail today.

2. You are responsible for every order

Every order that leaves your machine is your order. This applies equally to:

  • orders you place by hand from the order ticket, option chain, basket or watchlist;
  • orders placed automatically by a strategy, scalper or action chain you deployed;
  • orders placed by an auto square-off rule, a profit or loss booking rule, or PANIC;
  • orders placed by a strategy that was running when you closed the application or lost your internet connection.

You are responsible for configuring risk limits appropriate to your account, for verifying which account is selected before you send, and for monitoring open positions. The software will refuse an order it can identify as dangerous, but it cannot know your intent.

3. No investment advice

Neither this website nor the software provides investment, financial, legal or tax advice. No feature of either — including strike selection, option greeks, the market analyser, implied volatility, probability calculations or any strategy template — is a recommendation to buy or sell anything. All calculations are provided for information only and may contain errors.

COMPANY NAME is not a registered investment adviser, research analyst, broker or portfolio manager, and does not manage, hold or have access to your funds or securities at any time.

4. No warranty and no guarantee of execution

The software is provided "as is", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

In particular, there is no guarantee that:

  • an order will reach the exchange, or reach it at the price or in the time you expect;
  • a stop loss, target or trailing stop will execute at the level you set — gaps, circuit limits, illiquidity and broker rejections can all prevent it;
  • market data displayed is accurate, complete, timely or free of gaps;
  • the application, your broker's API, your internet connection or the exchange will be available when you need them;
  • positions, orders or profit and loss shown on screen match your broker's records. Your broker's records are authoritative.

5. Closing the application does not close your positions

Open positions and working orders are held at your broker, not in the software. Closing APEX or Omega does not square off any position and does not cancel any pending order. If you need to be flat, square off explicitly before you close, or do it from your broker's own platform.

A strategy stops being managed the moment the application stops running. Stops and targets placed at the broker using the broker-protect feature will remain live; everything decided in software — trailing stops, wait-and-trade triggers, action chains, portfolio-level rupee rules — will not.

6. Broker prerequisites and compliance

You must hold your own account with a supported broker and enable API access under their terms. You are responsible for complying with your broker's API terms of service, with exchange rules, and with all applicable regulations in your jurisdiction — including any registration, approval or disclosure requirement that applies to automated or algorithmic order placement.

Some brokers impose additional requirements, such as IP whitelisting before API orders are accepted. Meeting those requirements is between you and your broker.

7. Test on paper first

Both terminals include a paper trading account that runs on real market data and sends nothing to any exchange. Test every workflow there before you risk capital — the order ticket, the option chain, basket execution, every strategy you intend to deploy, PANIC and your square-off rules.

8. Limitation of liability

To the maximum extent permitted by law, COMPANY NAME and its contributors shall not be liable for any trading loss, loss of profit, loss of data, business interruption, or any direct, indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of, or inability to use, the software — whether or not they were advised of the possibility of such damages.

9. Questions

If anything here is unclear, do not connect a live account until it is. Contact [email protected].
